Terms and Conditions for Photography & Videography
1. Binding Agreement By engaging Kashmapro, the Client explicitly agrees to be legally bound by these Terms and Conditions. No variation of these terms shall be binding unless agreed upon in writing by Kashmapro.
2. Bookings, Deposits, and Clearances
Securing Dates: No date is officially reserved until a signed contract is executed and any required retainer or deposit is paid in full.
Access Clearances: The Client is solely responsible for securing all necessary permits, passes, and venue clearances required for Kashmapro’s crew and equipment. Kashmapro accepts no liability for production delays caused by venue access restrictions.
3. Payment Terms & Late Fees
Payment Schedules: All payments must be strictly settled according to the milestones defined in the specific project contract.
Late Payments: Kashmapro reserves the right to withhold all final deliverables, editing files, and usage licenses if any outstanding balance remains unpaid past the due date.
4. Cancellation and Rescheduling Policy
Cancellation Fees: Because large-scale events and corporate summits require extensive logistics and crew booking, cancellations made by the Client will result in the forfeiture of the deposit.
Rescheduling: Any requests to reschedule an event must be submitted in writing. Acceptance is subject to Kashmapro’s availability, and additional rescheduling fees may apply to cover committed resources.
5. Intellectual Property & Strict Copyright Protection
Ownership: Kashmapro retains absolute copyright and intellectual property ownership over all raw footage, photographs, and final edited materials.
Usage License: Upon final payment receipt in full, the Client is granted a non-exclusive, non-transferable license to use the delivered assets for corporate growth and promotional marketing. Any utilization of the assets prior to final payment is strictly prohibited and constitutes a copyright violation.
Portfolio Rights: Kashmapro reserves the right to use any captured imagery and videos for its own portfolio, marketing, and promotional showcase, unless a non-disclosure agreement (NDA) is explicitly signed beforehand.
6. Limitation of Edit Requests (Scope Creep)
Review Rounds: The final contract price includes a specific number of editing review rounds (typically two rounds).
Additional Edits: Any major creative changes, re-editing, or additional revision requests outside the originally agreed scope will be subject to additional hourly or flat-rate production fees.
7. Force Majeure & Limitation of Liability
Equipment & Technical Contingency: Kashmapro utilizes top-tier, professional equipment. In the highly unlikely event of total equipment failure, severe weather, or force majeure that prevents event coverage, Kashmapro’s total liability is strictly limited to the refund of monies paid by the Client. Kashmapro shall not be liable for any indirect or consequential damages.
8. Governing Law
These Terms and Conditions are governed exclusively by, and construed in accordance with, the commercial laws of the Kingdom of Bahrain.
